10 Year Limited Warranty

InvisARail® -Stainless and Aluminum infill railing system

Based on the terms listed below, 3G Industries, LLC (“3G”) provide a 10 Year Limited Warranty (“Limited Warranty”)  to the Original Purchaser and Residential Home Owner (“Owner”) of the real property of which the InvisARail® was installed.  This Limited Warranty covers all parts of the “InvisARail®” infill system collectively, but does not warrant in any way the parts it is attached to.

LIMITED WARRANTY- For the period of ten (10) years after the date of the original purchase, 3G’s product “InvisARail®” shall be free from defects of the material and the workmanship when used under normal conditions, and installed and maintained to the specifications shown in the Installation Guide and Maintenance Guide.

PLEASE NOTE THIS LIMITED WARRANTY IS THE ONLY WARRANTY FOR THE InvisARail® PRODUCT.  3G MAKES NO OTHER WARRANTIES, GUARANTEES OR INDEMNITIES EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, ANY WARRANTY OF MERCHANT ABILITY OR FITNESS FOR A PARTICULAR APPLICATION OR SUITABILITY OR SAFETY OR THE DETERMINING OF EFFECTIVENESS.  NO WARRANTY WILL BE ACCEPTED EXPRESSED OR IMPLIED FROM EMPLOYEES OF 3G, RETAILERS, SALES REPRESENTATIVES AND AGENTS OR OTHERS ARE HEREBY DISCLAIMED.

NOT INCLUDED IN THE LIMITED WARRANTY – The 3G Limited Warranty assumes no responsibility and no implied warranty shall be deemed to cover any product failure, product malfunction or damages caused by:

(A) Poor or improper installation and not following 3G installation guide

(B) Using the InvisARail® for other than its intended use

(C) Not following Owners local building codes

(D) Distortion or movement caused by collapse or settling

(E) Any acts of nature, hurricanes, flooding, wind damage, earthquakes, lightening, and the likes, etc…

(F) Environmental conditions, such as salt water,  salt spray, vandalism, corrosive elements, chemicals, air pollutants or other foreign substance (such as abrasives, harsh cleaners, paint strippers, etc…)

(G) Improper care and handling, storage, abuse or neglect by Owner, transferee (shipper) or third parties

(H) Attaching InvisARail® to an incorrect rail system (such as Owner supplied rails that do not have the structural integrity to anchor to or support the infill system, InvisARail®.  It will be the Owner’s sole responsibility to make certain the rails are sufficiently capable of supporting InvisARail®)

(I) Failure for the Owner to observe any safety precautions or methods in the use, care and handling of the InvisARail®

(J) Normal weathering due to exposure to sun light, weathering, atmosphere which can cause some discoloration

(K)Any fasteners or parts that not supplied by 3G system

(L) 3G parts purchased from a third-party liquidator,clearance sales, auction web sites or unauthorized dealer

(M) The ordinary wear and tear of the InvisARail®

(N) Any InvisARail® part whose identifying marks have been defaced or removed

Owner is solely responsible for determining the effectiveness, fitness, suitability, local code compliance, and safety of InvisARail® in connection with their use in any particular purpose.

IF OWNER FINDS A DEFECT, HERE IS WHAT TO DO:

If owner finds a defect during but not beyond the Limited Warranty period (such as between the Owner purchase receipt date and 10 years later) Owner must present the issue to 3G within 30 days after discovery of the alleged defect.  This notification must be in writing and sent to the following address:

WHAT MUST BE INCLUDED WHEN SUBMITTING A NOTIFICATION?:

Owner must include a copy of the original proof of purchase and a statement explaining the issues pertaining to the defect.  If possible, please include pictures showing manufacturer’s defect to help prove the issue.

WHAT WILL 3G DO TO CORRECT THE PROBLEM?:

If the Owner discovers a defect in any part of 3G product “InvisARail®”, 3G will do one of the following at its sole and absolute discretion: Repair the product, Replace the product, or Refund the purchase price.  (not included in the  Limited Warranty is the cost of labor for removal or labor for replacement, nor shipping expense from owner to 3G, however, shipping expense from 3G to owner will be paid by 3G) If a defect is determined and is valid based on the above and in accordance with disclaimers, 3G will either Repair the defected part at no charge, Replace the product at no charge, or if the product no longer exist, Replace with a similar product of equal or better value or Refund the purchase price as shown on the original receipt less shipping cost.  If replacement or repair is the determined solution by 3G, 3G will not guarantee the colors will be an exact match due to the defected product being in weather or aging or just manufacturing changes that cause color to be not uniform.  Any parts that are replaced will keep the remainder of the warranty period or 90 days after shipment is received, whichever is longer period.  THIS IS THE SOLE REMEDY FOR ANY DEFECT RELATED TO THE PRODUCT.

PRORATION: If Owner makes a valid warranty claim related to the InvisARail® only during the warranty period, a prorated system will be used as follows for recovery.  The recovery for the parts replacement, it may choose to replace the percentage listed or if refunding, pay the percentage listed: (1 to 5) years after Owner purchase receipt – full 100% recovery,(5 to 6) years -80% recovery, (6 to 7) years – 60% recovery, (7 to 8) years – 40% recovery, (8 to 9) years – 30% recovery, (9 to 10) years – 20% recovery.

RECOVERY TIME FROM 3G: 3G will respond normally within 30 days or reasonable time based on situation.

OWNERSHIP OF PRODUCTS: In the event that the product is exchanged or replaced, the replaced product becomes the property of the Owner and the defected product becomes the property of 3G.  Same is true if 3G refunds the purchase price less shipping and installation, the defected product becomes the property of 3G.

TRANSFER OF WARRANTY: There is no transfer of warranty from Owner.  This warranty is to the original Owner only.

Limitation of remedies and exclusion of consequential and incidental damages: 3G LIABILITIES ARE LIMITED SOLELY AND EXCLUSIVELY TO THE OBLIGATIONS SPECIFICALLY UNDERTAKEN HEREIN, AND UNDER NO CIRCUMSTANCES WILL 3G, IT’S OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, AGENTS AND ANY AFFILIATED COMPANIES BE LIABLE OR OBLIGATED FOR ANY INCIDENTAL, CONSEQUENTIAL, INDIRECT, SPECIAL, PUNITIVE OR ANY OTHER DAMAGES OF ANY KIND WHATSOEVER (INCLUDING BUT NOT LIMITED TO, LOST PROFITS, LOST SALES, LOSS OF GOODWILL, USE OF MONEY, USE OF GOODS, STOPPAGE OF WORK. OR IMPAIRMENT OF ASSETS), WHETHER FORESEEABLE, ARISING OUT OF BREACH OR FAILURE OF EXPRESS OR IMPLIED WARRANTY, BREACH OF CONTRACT, FRAUD, MISREPRESENTATION, NEGLIGENCE, STRICT LIABILITY IN TORT OR OTHERWISE, EXCEPT AND ONLY TO THE EXTENT THIS LIMITATION IS SPECIFICALLY PRECLUDED BY APPLICABLE LAW OF MANDATORY APPLICATION.  3G LIABILITIES WITH RESPECT TO DEFECTIVE PRODUCTS SHALL IN NO WAY OR EVENT EXCEEDS THE REPLACEMENT OF SUCH PRODUCTS OR REFUND OF THE PURCHASE PRICE, AS DESCRIBED ABOVE.

NOTE: Some states and provinces do not allow limitations on how long an implied warranty lasts so the above limitation may not apply to you.

NOTE: Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may or may not apply to you.

NOTE: This Limited Warranty gives you specific legal rights, and you may also have other rights that vary from province to province and from state to state.

NOTE: If for some reason any of the terms of this agreement or any provision become invalid, the remaining terms and provisions shall remain in effect and enforced to the fullest extent of the law.

This Limited Warranty may not be altered or amended without a written signature from a 3G’s officer(s).  By no means can the Limited Warranty expressed herein be altered by any agent, sales person, employee, retailer or any other party, therefore 3G will not be bound for any such statements other than those contained in this Limited Warranty.

3G reserves the right to discontinue or change the products covered under this Limited Warranty at any time without notice.  In the event the product under warranty is discontinued, 3G may fulfill the obligation of replacement with a similar product of equal or greater value.

3G Reserves the right to change this Limited Warranty from time to time without notice, however this will not affect products purchased under this Limited Warranty while it is in effect. 

This Limited Warranty is effective for purchases of InvisARail® on or after January 1st, 2014

Care

When cleaning is needed, NEVER use harsh cleaners, acids, steel wool or abrasive pads that can etch and destroy the aluminum anodized coatings or cause stainless to corrode.  Best and safest cleaners are warm water with mild dish washing detergent or automotive car care soaps that have spot free rinse.  Always rinse thoroughly with clean fresh water when done.  Since the InvisARail® is meant to be transparent, it is also designed to have a dull flat finish to be non-reflective.  Therefore, no polishing is expected and would be unnecessary additional work that’s counterproductive.

If you are near salt water areas, the accumulation of salt should be cleaned off regularly to extend the life of the product.  The cleaning frequency will be based on the proximity of the rail to the salt water and the amounts of salt that accumulates over time. 

If working with any metal that rust (Iron rails, grinding or shavings) nearby, keep it away from the rail for it could cause staining that is hard to remove if left for a long period of time.
